The Terms & Conditions of sale detailed below only govern the contractual relationship between the User/customer, hereafter referred to as «You» and Big Bag Shop, SL; hereafter referred to as «We» and as «BAGSZONE».

 

These Terms & Conditions of sale are applicable only to the bagszone Websites: (www.Bagszone.com, Bagszone.es, Bagszone.de, Bagszone.at, Bagszone.be, Bagszone.ch, Bagszone.co.uk, Bagszone.dk, Bagszone.eu, Bagszone.fr, Bagszone.it, Bagszone.nl, Bagszone.us)

1. INTRODUCTION

1.1 The object of the Terms & Conditions is that BagsZone sells its products and delivers them for an economic exchange.

1.2. Confirming your order through our website, you unreservedly accept our Terms & Conditions of sale, having read them and using them correctly.


2. EFFECTIVENESS

2.1. By confirming your order under these Terms & Conditions, the contract between BagsZone and the client is set up in which to distribute the products. There will be no application of other Terms & Conditions.

2.2. Once the client accepts these general conditions it is understood that he has read them and agreed with all the Terms & Conditions.


3. ORDERING A PRODUCT

2.1. You must be at least 18 years old to order.

2.2. The customer has a form to fill-out on our websites (24 hours a day and 7 days a week), once you have accessed the page and CliCk the bUtton "Proceed to checkout".

3.3. After making your order, you will receive your order number.

3.4. If we accept a new order, we will notify the client of our acceptation sending a confirmation order by email. In case of no email we will contact the client by telephone.

3.5. It is our aim to distribute products confirmed by our clients, but it could happen that some of the products could be out of stock. If that is the case we will immediatly inform the client and find the best way to solve it. We will always offer the possibility to choose another product. In case the client does not accept the alternative we will cancel his order and return the payment. This return of funds is the limit of our responsibility to the client when we are not able to distribute the product hoped for.
Rarely, the price of a product could be not well specified. If that happens we will immediately inform the client to send a new confirmation order. In case the price might be much higher, the client will be able to cancel his order and we will return the payment.

3.6. The time to cancel an order stops at 12 o'clock Spanish time, (working days), after a confirmed order. During this period a cancelation could be made without any extra fee.


4. PRODUCT DISTRIBUTION

4.1. We deliver the indicated product of your confirmed Order, according to the Terms & Conditions.


5. PRODUCT INFORMATION

5.1. Published product details, specifications and suitability information, received from our manufacturers and co-workers, is for us the best available at the time. We respect all market standards by using the best technology.


6. PRICING

6.1. Price of product will be specified on the website. Price and Conditions could be changed at any time. We reserve the right to change the prices at any time but products are invoiced at the price applicable when the order is registered.

6.2. From the moment we receive your order we reserve the right to recover the amount.

6.3. The prices for the products are indicated as below:

For European Union customers, the price displayed for each item sold by us includes Spanish VAT (18%). If we are shipping your order to a tax-free zone within the EU, we can deduct the VAT on prices, you just have to indicate this in the field "Any comment or special request?" during the checkout process. We will remove the VAT when we charge the order.

For other worldwide customers, the price displayed will be billed with VAT deducted. Please note that local tax and customs duty may apply. For full details please consult your local Customs office.

We reserve the right to change its prices at any time but products are invoiced at the price applicable when the order is registered.

6.4. The shipping service costs are not indicated in the price of the products. The shipping service costs borne by the customer and added to the total amount of the selected products. You will be informed of such costs before confirming the order and complete the hiring process.

6.5. We reserve the right to change our prices at any time. However, we are committed to applying the current rates listed on the site at the time the order is placed by the customer.

6.6. Please note that if an incorrect price appears for whatever reason (for example: computer bug, manual or technical error ...), the order will be canceled even if it was initially valid.

7. AVAILABILITY / ESTIMATED DELIVERY TIMES

7.1. We do our best to ensure availability of all advertised products and endeavor to dispatch all parts within the quoted time. If there is a delay we will inform you of this via email and the product will be dispatched as soon as it is available. If you have ordered multiple items they may arrive separately.

7.2. We have no liability to you for any delay in the delivery of products ordered. We will do our best to get all orders sent out as quickly as possible. You have the right to cancel delayed orders at any time, just contact us with your order number. Occasionally we find ourselves having to withdraw an item because it has become obsolete or has been discontinued. If you have placed an order for an item that has been made obsolete we will inform you as soon as possible and offer you an alternative if available.


8. SECURE PAYMENT

8.1. BagsZone uses Redsys (via La Caixa), MoneyBookers and PayPal to guarantee the security of your payments.

8.2. Please note that if the security department suspects fraud, BagsZone have the right to cancel the transaction for security reasons.

8.3. BagsZone offers 3 methods of payment:

- By Credit/Debit card:

We accept Visa, MasterCard, Verified by Visa / MasterCard Secure. Your Credit/Debit card will be charged at the time of placing your order through our secured payment "Secure Socket Layer". For security reasons BagsZone reserves the right to ask the client for ID and address.

- By bank transfer payments:

You will find our banking details when finishing the order as well as by email on the order confirmation; you will be able to perform the transfer at your bank. As soon as we received your payment, the order will be shipped. Before selecting bank transfer as your payment method, please be aware that your bank will charge you an international transfer fee, therefore increasing the overall cost of your order. Once your payment is received, we will dispatch your goods. The processing of off-line payments may take several days.
Important: Please transfer the total invoice amount using your name and the reference indicated when you are finishing the order.

- By PayPal :

For PayPal payments you can send the money directly to our PayPal account.

8.4. If the purchase was made by a consumer or a business, BagsZone sends the invoice. It will show the breakdown of the value added tax if applicable and shipping.
BagsZone reserves the right to refuse an order placed which has not been totally paid.

9. DELIVERY METHODS

9.1. We deliver items to the address clients have filled in the form.

9.2. You must select your preferred shipping method from the pull-down menu that appears in the shopping cart. This selection can only be made during the ordering process.

9.3. If your product is shown to be "in stock" on our Websites when you place your order, the number of days between the order date and the date that the courrier first attempts to deliver to the given address can be calculated as follows:

1. Dispatch time (24-48 hours) = payment validation + order preparation + parcel collection by courrier

2. Delivery time of your parcel(s) according to the courrier you have chosen. courrier delivery time starts from the moment you receive an e-mail confirming order dispatch.Dispatch and delivery times are given in working days.

9.4. We will deliver the product once BagsZone has verified that the effective realization of the payment has been executed correctly, and then we will deliver the product according to the option chosen:

Delivery for the European Union:

. DHL Air: Express Air Service. All products in stock are delivered to your delivery address within approximately 2 working days.

. SEUR - DPD – CALBERSON - BARTOLINI: Road Transport. All products in stock are delivered to your delivery address within approximately 1-5 working days.

Delivery outside the European Union:

. DHL Air Worldwide Express: Express Air Service. All products in stock are delivered to your delivery address within approximately 2-5 working days. Our courrier do not deliver to military zones or mailboxes.


9.5. Delivery hours include working days only, excluding Saturdays, Sundays and holidays. If for any reason attributable to BAGSZONE this period is exceeded, customer will receive an email informing about the incidence and proposing alternative solutions.

9.6. The customer agrees that he or another person designated at home are suitable for receiving the package. Should they not be in the first time, the courrier will try to deliver the product several times. If the order has been impossible to deliver, the product will be returned to us, with the consequent return of payment to the customer less the shipping and return of the product.

10. PRODUCT GUARANTEES

10.1. All BagsZone products have international guarantee. If you find a defect, we will repare or replace, refund or exchange it.

10.2. BagsZone allows you two months to return/exchange a product where you find a deffect. Your right of retraction starts from the moment your order is delivered. You can return/exchange the product within this time frame, at no charges, with your invoice and the completed Returns Form. In case you wish to exchange the product, we will send the parcel free of charge via the standard delivery.


11. RETURNS/EXCHANGES

11.1. BagsZone allows you 30 days to return/exchange a product that you are not satisfied with.

11.2. The present right of return/exchange only applies to products that are returned in their original and complete working condition (packaging, accessories, user guide etc.). Any product that has been damaged, is not in its original packaging, has packaging that has been worn beyond simply opening the product, will not be refunded.

11.3. You have the right to cancel your order, return or exchange your item within 30 days:

* We will happily refund or exchange any item purchased on BagsZone Websites.

* Returned goods must be unused and supplied with their original packaging.

* All returns or exchanges must have a completed the returns form.

NOTE: Please wrap the item and do not put tape or stickers directly on the box / packaging.

11.4. Provided that the products are returned to us undamaged we will refund the amount paid for the products.

11.5. Any products purchased during Flash Sales cannot be returned to BagsZone except in cases of manufacturing defects or damage occurred during shipment.

13. RESPONSIBILITY

13.1. For all stages, from access to the Websites, browsing, filling in forms, placing an order, delivering items or any other service, BagsZone only has an obligation for due care. Therefore, BagsZone cannot be held responsible for any inconvenience or damages arising from the use of the Internet and completely outside the diligence and precautions taken by BagsZone.


13.2. The customer agrees to complete the order forms and fields according to the instructions. BAGSZONE will protect the data according to the law. The customer also agrees to pay the price of the product, including taxes and shipping costs.

 

13.3. Please note that it is advisable to keep a copy of the order details. BAGSZONE is not responsible for any loss of data, files or, in general, for any damage resulted from a backup failure or loss of the data contained in the products purchased by the costumer.

 

13.4. BAGSZONE is not responsible for the consequences that may result from improper use of products sold on their online store.


14. REVIEWS & COMMENTS

14.1. We encourage you to leave reviews, comments and product questions on our Websites. Regularly monitor this content we reserve the right to remove, reject or edit it at any time. When submitting information to our Websites as a review, product question or customer comment you understand that what you have submitted is not copyright protected and you are permitting its appearance on the Bagszone Website.

15. PERSONAL DATA PROTECTION

15.1. The personal data that the client should give us is essential for sending orders and drafting bills. The absence of this data will result in the automatic cancellation of orders. By entering the page, the customer agrees to provide valid personal data, that enables the provision of service by BAGSZONE, correct identification of the customer registration, information on delivery and advertising of various products and offers BAGSZONE may have on their websites.
